Dr. Bruce Gillis' testimony in Ohio mold case stands up to Ohio Rules of Evidence Rule 702 "Daubert" challenge.

 

In June of 2009, Ohio Magistrate Myron A. Thompson overruled "Defendants' Motion to Exclude Testimony" in ruling that Dr. Gillis’ expert testimony in Case No. 05CVG09-9840 satisfied Ohio Evid. R. 702 for scientifically valid differential diagnoses and science used to support his testimony.  Differential diagnosis is a standard diagnostic tool in medicine and an accepted clinical method for an expert witness’ conclusions to satisfy the Daubert requirements for reliability.  In this particular case, the Magistrate determined that the seven elements of consideration comprising Dr. Gillis’ differential diagnosis satisfied the requirements for reliability under Evid. R. 702 (C), as interpreted by both the U.S. and Ohio Supreme Courts.
